The Council will consider granting in-principle approval for the closure and transfer of a portion of public place (Erf 4601 Simon's Town) at Hopkirk Way, Glencairn, to the owner of adjacent Erf 2235, Lara McGillewie.
This item concerns a small piece of municipal land (Erf 4601, Simon's Town) on Hopkirk Way in Glencairn, a coastal suburb of the Simon's Town area on the False Bay side of the Cape Peninsula. Glencairn Extension No. 1 was surveyed and sold off by the Simon's Town Municipality after 1945, and it ran as far as Hopkirk Way. That history helps explain why small leftover parcels of public land can sit beside private plots in older parts of the suburb.
In South African municipal practice, a "public place" is land such as a street, open space or verge that is held for public use. The City generally cannot sell or give away such land until it has been formally closed. Closure is normally handled under the City's Municipal Planning By-law, together with its policy on the management and disposal of immovable property. The usual steps are:
In-principle approval is therefore not the final decision. It lets the process go ahead, and objections can still be considered afterwards.
This matters because public land is a community asset. Closing and transferring even a small portion can affect access, servitudes, views, drainage, fire breaks and neighbours' interests. In Glencairn, fire risk is a particular concern. A large blaze burned on the slopes of Simon's Town and along the Glencairn Expressway in December 2023. I could not find any published City documents specific to this application.
